Mountainwood Farms provides tractor-based property cleanup, field mowing, brush hogging, and driveway grading. We will only perform the services explicitly outlined and agreed upon in the provided quote/estimate.
Mountainwood Farms operates heavy machinery that alters the surface of the ground. It is the sole responsibility of the property owner/customer to locate and clearly mark all underground utilities, septic systems, drain fields, irrigation lines, invisible dog fences, and shallow pipes prior to our arrival. Mountainwood Farms assumes zero liability for any damage to unmarked, improperly marked, or shallow subsurface objects.
The customer is responsible for accurately identifying and indicating their property lines. Mountainwood Farms accepts no liability for services inadvertently performed on neighboring properties due to incorrect or vague boundary information provided by the customer. The customer agrees to indemnify Mountainwood Farms against any neighbor disputes arising from incorrect boundary designations.
Our equipment is designed to process vegetation and move earth—not concrete, steel, wire, or hidden garbage. If the customer designates an area for service, they certify the area is free of hidden, machine-destroying hazards (e.g., T-posts, thick wire/cable, engine blocks, large boulders hidden in tall grass). If Mountainwood Farms equipment is damaged by undisclosed or hidden man-made debris, the customer assumes full financial responsibility for the repair or replacement of the damaged equipment, plus lost downtime.
While we take professional precautions to respect your property, operating heavy tractors inherently involves risk. Mountainwood Farms is not responsible for superficial ground scuffing, rutting caused by soft/wet ground conditions, or minor damage to turf/landscaping required to physically access the work area.
Tractor work is heavily dependent on weather and ground conditions. Mountainwood Farms reserves the right to reschedule services due to rain, excessive mud, or unsafe conditions. Furthermore, we reserve the right to stop work or refuse service upon arrival if the property conditions are deemed unsafe for our operators or machinery (e.g., extreme, un-communicated slopes, hidden hazards).
Payment is due in full upon completion of the agreed-upon services unless an alternate billing schedule (such as a recurring maintenance plan) has been established in writing. Late payments may accrue interest at the maximum rate permitted by Oregon law.
To the maximum extent permitted by law, Mountainwood Farms' total liability for any claims arising out of or related to our services shall not exceed the total amount paid by the customer for the specific service in dispute. We are not liable for any indirect, incidental, or consequential damages.
You agree to indemnify, defend, and hold harmless Mountainwood Farms, its owners, and employees from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from your failure to mark utilities, your failure to disclose hazards, or any breach of these Terms.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, controversy, or claim arising out of, relating to, or in connection with these Terms, our Privacy Policy, or the services provided by Mountainwood Farms, shall be resolved exclusively by binding arbitration rather than in court. The arbitration shall be conducted in Washington County, Oregon, under the rules of the American Arbitration Association (AAA). Class Action Waiver: You and Mountainwood Farms agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Oregon, specifically applying to Washington County.
